Terms of Use
ToonChatter is a messaging app that turns a chat between friends into a comic book. It is run by James Alderson in Hanalei, Hawaiʻi ("we", "us"). By creating an account or using ToonChatter you agree to these terms. If you don't agree, please don't use it.
1. Who can use ToonChatter
- You must be 18 or older. ToonChatter turns real photos into drawings, and the drawing service we use does not allow photos of anyone under 18 to be edited. We do not knowingly allow anyone under 18 to have an account, and we delete accounts we learn belong to minors.
- We ask for your birth year when you sign up. Give the real one.
- Keep your password private. You are responsible for what happens under your account.
2. Your photos and your comics
- You own the photos you upload and the comics you make. We don't claim them.
- You give us permission to store your photos and comics, to send your photos to the drawing service to make your character, and to show your comics to the people in your stories. If you make a story public, you give us permission to show it to anyone.
- Only upload a photo of yourself, or of someone who has clearly given you permission. Never upload a photo of someone under 18 other than yourself. If someone asks you to stop using their face, stop.
- Pictures made by the drawing service are made by a computer. We can't promise they are unique, and copyright law may not protect them.
3. What is not allowed
Don't use ToonChatter to make, post or send:
- Racism, or hate or contempt toward anyone because of their race, color, creed, religion, national origin, sex, sexual orientation, gender identity, disability or age
- Harassment, bullying, threats or intimidation
- Nudity or sexual content
- Anything sexual, violent or exploitative involving anyone under 18
- Someone else's photo or likeness without their permission
- Real violence, cruelty, self-harm or illegal activity presented as real
- Impersonation of a real person, or false claims presented as fact
- Spam, scams, or anything that breaks the law
We decide what crosses the line. We may remove content and close accounts at any time, with or without notice, and we don't owe a refund for an account closed for breaking these rules.
4. Private and public stories
- Stories are private: only the people invited into a story can see it. Don't share invite links with people you don't want in the story.
- A story can be made public only if every member of the story agrees. A public story can be seen by anyone, and anyone can report it.
5. The drawing service
Your character and panels are drawn by an outside AI drawing service (currently OpenAI). It sometimes refuses a picture or draws something odd. We pass your photo and your description to it only to make your picture, and we don't control how it works.
6. Credits and payments
ToonChatter is free to use while we build it. When we start selling panel credits, prices will be shown before you pay. Credits are for your own use, have no cash value, and are not refundable except where the law requires it. Payments are handled by a payment company (such as Stripe); we never see your card number.
7. Reporting and removal
If you see something that breaks these rules, use the Report button or email 4agreatlife2live@gmail.com. If your face appears in a story without your permission, tell us and we will remove it.
8. Ending your account
You can delete your account at any time from your account settings. Deleting your account removes your photos and your own panels. Panels you made in a shared story may stay in that story for the other members.
9. No guarantees
ToonChatter is provided "as is". We work hard to keep it running, but we can't promise it will always be available or error-free, that pictures will come out the way you want, or that your comics will be kept forever. Back up anything you love with the Save button.
10. Limits on our liability
To the fullest extent the law allows, we are not liable for what members make, say or do on ToonChatter, for anything made by the drawing service, or for any indirect or consequential loss. If we are ever found liable to you, our total liability is limited to the amount you paid us in the past twelve months, or $20, whichever is more.
11. Changes
We may update these terms. If the change matters, we'll show a notice in the app. Using ToonChatter after a change means you accept it.
12. Law
These terms are governed by the laws of the State of Hawaiʻi, USA.
